
Every oil change your bays produce generates used oil, and that used oil is a regulated byproduct at both the federal and state level. Under EPA 40 CFR Part 279, the Used Oil Management Standards, and Florida's Used Oil Recycling Act (Florida Statutes 403.75 through 403.769), a South Florida shop that generates used oil must store it in closed containers labeled "Used Oil," move it off-site only with a certified transporter, and never mix it with coolant, solvents, or other waste streams that could push it into hazardous waste classification. If your shop does oil changes, knowing these rules is part of running a clean operation. A leaking tank, an unlabeled drum, or a batch contaminated with coolant can turn a straightforward waste stream into a compliance problem that costs far more to fix than to prevent.
Why used oil is not hazardous waste, and what keeps it that way
Used oil from a service bay, the engine oil, transmission fluid, gear oil, and hydraulic oil that comes out of vehicles, is managed under its own federal standard (40 CFR Part 279), not under the general hazardous waste rules that apply to listed and characteristic hazardous wastes. That separation matters: used oil rules are simpler, and keeping used oil in its own stream means it can be re-refined, recycled, and burned as a fuel supplement in permitted facilities rather than handled as hazmat.
The line that crosses a batch into hazardous waste territory is contamination. EPA's rebuttable presumption rule (40 CFR 279.10) holds that if a batch of used oil contains more than 1,000 parts per million total halogens, EPA presumes it has been mixed with halogenated hazardous waste, typically a chlorinated solvent. Once that presumption applies, the batch must be managed as hazardous waste unless you can rebut it with documentation showing no mixing occurred.
The practical takeaway: keep your used oil tank limited to vehicle lubricants and keep solvents, coolant, and other waste streams out of it. That single discipline is what keeps the batch in the used oil program and out of the hazmat lane.
How to store used oil in your shop
Federal rules under 40 CFR Part 279 set the generator requirements, and Florida DEP enforces state rules that track closely with the federal standard:
- Store in closed, leak-proof containers. A drum, a tank, or an IBC tote all qualify. Open containers do not.
- Label every container "Used Oil." That label is a federal requirement, not a suggestion, and it distinguishes the container from unlabeled waste that inspectors may classify differently.
- Inspect storage containers regularly for leaks or corrosion. A slow-leaking drum dripping onto the shop floor creates a spill record and can trigger cleanup requirements under Florida DEP rules.
- Use secondary containment under drums or tanks. A drip pan under a drum is standard practice; a concrete berm around a larger storage tank is the norm for high-volume shops.
- Do not overfill. A container that runs over creates a reportable spill in Florida.
The cleanest setup for a busy shop is a dedicated used oil tank with a pump, clearly labeled, inspected on a schedule, with a drip pan or berm underneath. Shops that use freestanding drums should treat them the same way: labeled, closed between uses, and inspected at least weekly.
Getting used oil picked up in South Florida
When used oil leaves your property, it must move with a transporter certified by Florida DEP. Federal rules (40 CFR 279.24) allow a generator to self-transport up to 55 gallons of used oil in the generator's own vehicle to an aggregation point or collection center without a transporter license. Above that threshold, or for any routine commercial pickup, you need a certified hauler.
Florida DEP certifies used oil transporters and maintains a registry. Most haulers serving Miami-Dade, Broward, and Palm Beach counties offer scheduled route pickup. A few practical points about the pickup relationship:
- Volume matters to your hauler. A shop generating a drum or more per pickup cycle typically gets faster scheduling and better service terms than one generating a few gallons at a time. Haulers optimize their routes by volume.
- Keep a pickup record. Florida DEP expects generators to document where their used oil went. Get a receipt or manifest from your transporter for every pickup and keep it for at least three years.
- Some municipalities and county programs in Miami-Dade and Broward operate used oil collection centers primarily for DIY oil changers, not commercial generators. Commercial shops generally need a licensed hauler rather than a public collection center.

What you cannot mix into your used oil tank
Contamination is the most common compliance problem with used oil. Mixing the wrong materials into the used oil tank can make the batch non-recyclable, trigger hazardous waste requirements, and make disposal more complicated and expensive. Here is what stays out:
Coolant and antifreeze. Coolant contains ethylene glycol or propylene glycol, which contaminates used oil and disqualifies it from standard re-refining. Coolant goes to a separate glycol recycler or a coolant-specific waste stream, not the used oil tank.
Diesel exhaust fluid. DEF is a 32.5% aqueous urea solution (ISO 22241). It does not mix with used oil and contaminates the batch. DEF spills and DEF waste go to a separate container.
Brake fluid and power steering fluid. These are hydraulic fluids with their own chemistry. Mixing them into the used oil tank can contribute to the halogen profile that triggers the rebuttable presumption test. Keep them in a separate labeled container.
Chlorinated solvents and parts-cleaning chemicals. This is the main hazard. Chlorinated solvents raise the halogen content of used oil above the 1,000 ppm threshold and push the batch into hazardous waste territory. Solvent waste belongs in a separate labeled container with its own disposal path through a licensed hazardous waste hauler.
Water. Water contamination does not trigger hazardous waste classification, but it degrades the batch's fuel value, promotes tank corrosion, and makes disposal harder. Keep the storage tank covered to reduce moisture intrusion.
The simple rule to post on the tank: engine oil, transmission fluid, gear oil, and hydraulic oil only. Everything else gets its own container.
